Users and Advertisers on www.Actuaryjobs.co.za (“Users” and "Advertisers") agree to be boundby the following terms and conditions.

 

Actuaryjobs.co.za is aweb site owned by Actuaryjobs SA Pty Ltd (2009/019187/07) (“Actuaryjobs”).

 

(1) Actuaryjobs does notmake any representation whatsoever about any Resume, Job or Project vacancy orFreelancer Profile advertised on the site, nor about any of the Advertisers whoappear in the “Employer/Recruiter Directory”. Users and Advertisers of Actuaryjobsmust satisfy themselves as to the suitability of any agency, employer,freelancer, job, project, or resume found directly or indirectly through thiswebsite.

 

(2) As a condition of using any servicessupplied by Actuaryjobs, Advertisers must comply with the Human Rights andEqual Opportunity Commission Act 1986 and all anti-discrimination and equalopportunity legislation. 

(3) Users andAdvertisers agree at all times to deal with any information or productsprovided by Actuaryjobs or accessed from the Site in a manner which abides byall applicable laws of Australia, or of any other relevant jurisdiction(including, without limitation, privacy and copyright laws).

 

(4) Actuaryjobs reservesthe right to either reject or remove any job posting, freelance projectlisting, freelancer profile listing, or resume from its site for any reasonwhatsoever, including any advertisement or listing that is in breach of any law.

 

(5) Advertisers agree to indemnify Actuaryjobs,its officers, employees and agents against all claims, actions, suits,liabilities, costs and expenses incurred on any account by Actuaryjobs as aresult of the listing or proposed listing by an advertiser on Actuaryjobs.com.auor any related site. 

(6) Actuaryjobs providesno warranty to Advertisers that services available through the Site will beuninterrupted or error free. Actuaryjobs agrees to use its reasonableendeavours to ensure that any disruptions to or a denial of access to its Sitewill be remedied as quickly as possible.

 

(7) Actuaryjobs will use its reasonableendeavours to post all advertisements and listings submitted by Users andAdvertisers in the format submitted to Actuaryjobs and in accordance with theinstructions of the User or Advertiser. Actuaryjobs makes every effort to avoiderrors in advertisements and listings it has agreed to post to the sitehowever, Actuaryjobs accepts no responsibility or liability for any errors andrequires that Users and Advertisers check their listings for errors as soon asthey are placed on the Actuaryjobs.com.au. 

(8) Actuaryjobs may, atits discretion and without further cost or notice to the User or Advertiser,partner with or syndicate Job, Resume, or Freelancer data to other third partyorganisations employment sites. Details of any partner or syndicate employmentsites will always be listed on the Actuaryjobs.com.au web site.

 

(9) Users andAdvertisers must not post any advertisement, listing, or any information relatingto pyramid schemes. Users and Advertisers also agree not to ask or require anyJob Seeker to pay a fee or any money whatsoever to apply for any job advertisedon the Actuaryjobs website.

 

(10) Users andAdvertisers agree not to use any feature of Actuaryjobs to send unsolicitedemails, to any person or business for any reason. Legitimate communicationtools provided within Actuaryjobs for the purpose of communicating withEmployers and Job Seekers are the exception to this rule.

 

(11) Users and Advertisersposting Jobs, Freelance Projects, Resumes, or Freelance Projects must postinformation that is accurate, truthful, and honest. Job and Freelance Projectpostings must be posted only for Jobs and Projects that are current andlegitimate at the time of posting. Job and Project postings on Actuaryjobs mustbe removed as soon as the positions are filled or for any reason no longercurrent.

 

(12) Advertisers mustensure that all advertisements posted on Actuaryjobs comply with all applicablelegislation, regulations, by-laws, ordinances or codes of conduct in allapplicable States and Territories of Australia.

 

(13) Advertisers agreeto keep Actuaryjobs, its officers, employees and agents fully indemnifiedagainst any actual or contingent costs, expenses, charges, damages orliabilities incurred in relation to any actions or claims brought by any personor entity against Actuaryjobs as a result of an actual or alleged breach by youof any law, regulation, by-law, ordinance or code of conduct or such otheractions or claims brought as a consequence of your posting appearing on Actuaryjobs.

 

(14) Advertisers may not assign or transfer anyrights and obligations pursuant to this agreement to any other person or entitywithout Actuaryjobs's prior written approval. Approval will not be unreasonablywithheld.

(15) Advertisers agree that Actuaryjobs retainsall intellectual property rights contained in any of the goods and servicesprovided to you by Actuaryjobs.

(16) Users andAdvertisers accept that Actuaryjobs cannot and does not screen, vet, or QA alljob postings, resumes, freelancer profiles, or freelancer projects posted on thesite. We do the best we can to ensure a high level of quality and accuracy but Actuaryjobsis not responsible for the validity or accuracy of information contained inthese postings. Actuaryjobs will not be liable for any loss, costs, damages orloss of profits sustained as a consequence of any User or Advertiser employingor engaging any person sourced through Actuaryjobs, or any job, contract,project, or freelance work sourced through Actuaryjobs.

 

(17) Actuaryjobs cannotand does not guarantee or warrant to the User or Advertiser that filesavailable on or emailed through the site will be free of infection or viruses,worms, trojan horses or other malicious or harmful code. Actuaryjobs will notbe liable to you for any direct, indirect, consequential, special or otherdamage resulting from the transmission from this website to your computersystems of viruses, worms, trojan horses or other destructive items, howevercaused, such damage to include, without limitation, loss of profits,interruption to business, loss of the whole or any part of a programme or anydata howsoever stored whether saved on a computer system or otherwise.

 

(18) Users andAdvertisers agree to comply with the National Privacy Principles set out underthe Privacy Amendment (Private Section) Act 2000.

 

(19) Access to the namesand contact details of job seekers in the resume database is available only toapproved Actuaryjobs Advertisers who have registered and paid for access to theresume database.

 

(20) Advertisers mayaccess and use the information stored on the candidate resume database solelyfor the purpose of identifying candidates for current or forthcoming jobvacancies. Advertisers must not use a job seeker’s resume or contact detailsfor any purpose other than to help that person find a job. Breach of thisclause may result in the Advertiser’s Actuaryjobs membership being cancelled.

 

(21) Advertisers agree that Actuaryjobs may, forthe purposes of assessing an Advertiser’s commercial credit application, obtainfrom either a credit reporting agency or other credit providers, personalcredit information about the Advertiser and/or its directors or a consumercredit report about the Advertiser from a credit reporting agency for thepurposes of collecting overdue payments relating to commercial credit owed bythe Advertiser. 

(22) Advertisers agreenot to post any information in any Job or Project listing that is misleading,dishonest or known to be incorrect.

 

(23) Job Seekers and Freelancers posting resumesand Freelance Profiles must ensure that their Resume or Freelance Profile isposted to the correct categories, the correct locations, and that all otherinformation is correct and accurate. 

(24) Advertisers postingJobs and Freelance Projects must ensure that advertisements are posted to theappropriate categories and location, and that all other information is correctand accurate.

 

(25) Actuaryjobsreserves the right to edit, re-categorise, change or update a Job or ProjectPosting, Resume, or Freelance Profile at any time. This is generally done tocorrect mistakes or omissions made by the User or Advertiser.

 

(26) All amounts owingto Actuaryjobs Pty Ltd ("Actuaryjobs") must be paid within 14 days ofthe date of.

 

(27) Refunds on credit card payments will bemade at the discretion of management. 

(28) "Work fromhome" or "Business Opportunity" advertisements are allowed onlyunder the following conditions: (i) The business must be based in Australia,(ii) Opportunities must not require any up front fee or payments of any kind (iii)The exact nature of the opportunity must be clearly specified in the ad. Vaguedescriptions or links to vague web sites are definitely not allowed. Any job orproject listings that we think breaches these conditions may be removed at anytime without warning or notification.

 

(29) This agreement isgoverned by the laws of New South Wales. Users and Advertisers irrevocably andunconditionally submit to the non-exclusive jurisdiction of the Courts of NewSouth Wales, and waive any objection to legal action being brought in those Courtson the grounds of venue or inconvenient forum.
